Section 1 Contracting party and scope
(1) Your contracting party for the use of neumascan is:
Lorenz Kutschka und Alexander Muhr
Untere Teichstraße 38a
8010 Graz
Österreich
E-Mail: hallo@neumascan.com
(hereinafter “neumascan” or “we”).
(2) These terms and conditions apply to all contracts for the use of neumascan at neumascan.com with an account: free use (Free) and the paid offers buying pages (“Finish this piece”) and page packs. neumascan does not offer subscriptions. For scanning as a guest without an account (Section 4 paragraph 1) and for guest scans of invited testers, Sections 2, 3, 10, 11 and 12 apply accordingly.
(3) Users’ own terms apply only if we expressly agree to them.
(4) A consumer within the meaning of these terms is anyone who concludes a contract for purposes that are predominantly outside their trade, business or profession. Rules that apply only to consumers are marked as such.
Section 2 What neumascan provides
(1) neumascan recognises printed music on photos and PDF pages you upload and turns it into an editable score: to correct in the score editor, to listen to and transpose, and to download as PDF, MusicXML and MIDI. With an account, your scans stay saved in your library until you delete them.
(2) Recognition runs automatically using an AI model and is designed for printed music: single parts and, as a beta, piano, choir and full scores with up to 5 staves per system. It may recognise notes or symbols incorrectly or not at all. The measure ledger flags measures that don’t add up and uncertain spots, but does not find every error. We do not promise any particular recognition accuracy. Please check every result before you use it — for playing, performing or publishing, for example.
(3) Which features belong to which offer is set out in Section 3 and on the pricing page. We keep developing neumascan and may change features where this is reasonable for you — for example to improve it, for security reasons or because of changed legal requirements — and the services under Section 3 are preserved. If a change affects your access or use more than only slightly, we will inform you in advance; as a consumer you may then terminate the contract free of charge under the rules of the Austrian Consumer Warranty Act (VGG).
Section 3 Offers, prices and pages
(1) The following offers are available:
| Offer | Price (incl. VAT) | Pages |
|---|---|---|
| Free | €0 | the first 4 staves of each scan (at least the first system), at most 5 scans per calendar month |
| Buying pages (“Finish this piece”) | €1.99 once per page, with volume bonus (Section 7) | the waiting pages of one scan (Section 8 (1)) |
| Page pack 10 + 1 | €19.90 once | 11 pages of balance, never expire (Section 8) |
| Page pack 20 + 3 | €39.80 once | 23 pages of balance, never expire (Section 8) |
| Page pack 30 + 5 | €59.70 once | 35 pages of balance, never expire (Section 8) |
(2) The score editor, listening and transposing, export as PDF, MusicXML and MIDI, the library, scans of up to 50 pages, capturing pages with your phone via a QR code, and an email when a scan is ready come with every account. The offers differ in how many pages neumascan recognises (paragraph 1).
(3) What counts as a page: a page with up to 12 lines of music counts as one page, with 13 to 24 lines as two pages, and so on for every 12 lines or part thereof. Pages are counted when recognition starts. If the pre-check rejects a page, it doesn’t count. If recognition fails on a page, we credit it back to you; “Try again” counts it again.
(4) Free: From every scan, neumascan recognises the start of the first page for free: the first 4 staves, for piano, choir or full scores whole systems up to 4 staves, but at least the first system. This applies to at most 5 scans per calendar month in Austrian time (Europe/Vienna). neumascan recognises the rest of the scan after you buy pages or from your balance (Section 8); the first page then counts in full.
(5) If you have a balance (Section 8 (4)), neumascan uses it automatically for a scan’s pages when you start it, in order, as far as it goes.
(6) Before you start a scan or buy pages, neumascan shows how many pages it counts and what the purchase costs. Without an account, you scan as a guest (Section 4 paragraph 1).
Section 4 Conclusion of the contract
(1) You conclude the contract for Free by creating an account. Without an account you can try neumascan as a guest: one scan with the free part of Free (Section 3 (4)), reachable only in the browser where you created it. We delete guest scans 90 days after they were created unless you take them over into an account before then; for more scans, to buy and to capture pages with your phone, you need an account; the same goes for page packs. You can buy the rest of your guest scan without an account (“Finish this piece”); Stripe asks for the email address for the receipt. A purchased guest scan is not deleted after 90 days, but stays reachable only in that browser until you take it over into an account.
(2) Page packs require an account with a confirmed email address; buying pages for a scan requires either such an account or a guest scan (paragraph 1). You choose the offer in your library or at your scan, confirm these terms and — as a consumer — that the service starts immediately (Section 9), and are forwarded to a page of our payment provider Stripe to pay. There you can review and correct your details. By clicking the payment button you make a binding offer; the contract is concluded as soon as the payment is confirmed and we activate the offer in your account.
(3) We send you confirmation of the contract, together with these terms and the withdrawal notice, by email.
(4) The language of the contract is German. You can view, save and print these terms at any time at neumascan.com/agb (German) and neumascan.com/en/terms (English).
Section 5 Prices and payment
(1) All prices are final prices in euros and include VAT.
(2) Payment is handled by Stripe (Stripe Payments Europe, Ltd., Ireland) using the payment methods offered at checkout. Buying pages and page packs are one-time payments, payable when ordered. Nothing renews, and no recurring payments are charged.
(3) Invoices and payment methods are in Stripe’s customer portal, which you open from your library.
Section 6 Term and end of contract
(1) Buying pages and page packs are one-time purchases with no term; there is nothing to cancel.
(2) You end Free by deleting your account in the settings. Any unused balance lapses with the account.
(3) The right of either party to terminate the contract without notice for good cause remains unaffected. Good cause for us is in particular a serious breach of Section 10, or one repeated despite a warning.
Section 7 Volume bonus
(1) Free pages are added to paid pages: one from 10 paid pages, three from 20, five from 30. Every further full 30 paid pages add another five (for example, 60 paid pages: ten free).
(2) The volume bonus applies to each purchase on its own; pages from different purchases are not added up.
Section 8 Buying pages, page packs and balance
(1) With “Finish this piece” you buy the recognition of the pages of one scan that are waiting for a purchase, for €1.99 per page. How many pages that is follows Section 3 (3). You only pay for as many pages as are needed, together with the free pages of the volume bonus (Section 7), to cover all waiting pages (for example 10 paid pages for 11 waiting ones). neumascan shows the price and the pages before you buy. Once paid, these pages start; if one fails, you can try it again at no extra cost (Section 3 (3)).
(2) The purchase applies to this scan and the pages that were waiting when you bought it. If pages from the volume bonus are left over, they go into your balance (paragraph 4). Pages you add to the scan later need balance or a new purchase.
(3) A page pack contains paid pages and the free pages of the volume bonus (Section 3 (1)): 10 + 1, 20 + 3 or 30 + 5 pages. The pages go into your balance once paid.
(4) Balance means pages you bought and have not used yet. Your balance never expires, works for every scan in your account and is used as set out in Section 3 (5).
(5) Balance and bought pages apply to your account (when buying as a guest: to the guest scan) and are not transferable. If we discontinue neumascan, we refund unused balance on a pro-rata basis.
Section 9 Right of withdrawal for consumers
If you are a consumer, you have a statutory right of withdrawal when you buy pages or page packs (right of withdrawal under Section 11 of the Austrian Distance and Off-Premises Contracts Act, FAGG). The following notice follows the statutory model.
Withdrawal notice
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us (Lorenz Kutschka und Alexander Muhr, Untere Teichstraße 38a, 8010 Graz, Österreich, e-mail: hallo@neumascan.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory. You can also withdraw using our withdrawal function “Withdraw from contract” at neumascan.com/en/withdraw (link in the footer of every page); we will then confirm receipt to you by e-mail without delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.
End of the withdrawal notice
Immediate start and expiry of the right of withdrawal
Pages you buy and page packs apply as soon as you have paid. For this, you expressly request at checkout that we begin the service before the withdrawal period ends, and confirm that you are aware of the following:
- If you withdraw afterwards, you pay a proportionate amount for the service provided up to that point (Section 16 FAGG).
- Your right of withdrawal expires once we have fully performed the service (Section 18 (1) no. 1 FAGG), for a page pack, for example, once all pages of the pack have been used, when you buy pages for a scan, once the pages bought have been recognised.
- Insofar as the service counts as the supply of digital content, your right of withdrawal expires as soon as the supply begins (Section 18 (1) no. 11 FAGG).
We confirm your consent and acknowledgement with the confirmation of the contract by email (Section 4 (3)).
Model withdrawal form
(Complete and return this form only if you wish to withdraw from the contract.)

Section 10 Your content and obligations
(1) Only upload music you are entitled to use — for example public-domain music or your own material. You ensure that uploading and recognition do not infringe the rights of third parties.
(2) The rights to your music and to the results remain with you or the rights holders. You allow us to store and process your photos, scans and results and to transfer them to the service providers we use, insofar as this is necessary for the service, and to view them for quality control as described in the privacy policy. We do not use them to train AI models.
(3) You may not use neumascan in an automated way or bypassing the website, share an account with others, or otherwise circumvent the free part.
Section 11 Warranty and availability
(1) The statutory warranty applies; for consumers in particular the Austrian Consumer Warranty Act (VGG).
(2) Recognition may contain errors (Section 2 (2)). Individual notes or symbols recognised incorrectly or not at all are therefore not in themselves a defect; there is a defect if neumascan does not work as described in Sections 2 and 3.
(3) We do our best to keep neumascan available at all times. Maintenance, disruptions at service providers (such as hosting or the AI model) and events beyond our control may cause interruptions; we do not promise any particular availability.
(4) We recommend downloading important results as MusicXML or MIDI and keeping your own copy.
Section 12 Liability
(1) We are liable without limitation for damage we cause intentionally or through gross negligence, and for damage arising from injury to life, body or health.
(2) In the case of slight negligence, we are liable only if we breach an essential contractual obligation — an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely — and only for the damage that was foreseeable and typical for the contract when it was concluded.
(3) Towards businesses, liability for slight negligence is excluded.
(4) Mandatory statutory liability, for example under the Product Liability Act, remains unaffected.
Section 13 Data protection
How we process personal data — including for payment via Stripe — is set out in the privacy policy (German).
Section 14 Changes to these terms
(1) We may change these terms for the future, for example if laws, case law or our services change. For existing contracts, a change applies only if you expressly agree to it; we send you the amended version for this by email at least 30 days before it is due to take effect.
(2) If you do not agree, the previous terms continue to apply to your contract.
Section 15 Final provisions
(1) Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, you keep the protection of the mandatory provisions of the law of that country (Article 6 Rome I Regulation).
(2) For consumers, the statutory places of jurisdiction apply. For businesses, the place of jurisdiction is Graz.
(3) Please send questions and complaints to hallo@neumascan.com.
(4) If a provision of these terms is invalid, the rest of the contract remains valid.
(5) These terms are also available in German; the German version prevails.
